Job Description


Accu-Tech Diagnostic Center is a state-of-the-art laboratory facility equipped with the latest technologies to provide accurate, reliable, and timely patient results at a reasonable pricing model. Operated as a joint venture between Millennium Healthcare Enterprise and Retina Pharmaceuticals, the Diagnostic Center is committed to maximizing positive community health impacts while ensuring compliance with legal, ethical, and environmental standards.

 

Purpose of the Role: – 

The Legal Advisor will be responsible for providing comprehensive legal counsel and support to ensure that Accu-Tech Diagnostic Center operates in full compliance with applicable laws, joint venture agreement terms, applicable regulations, and ethical standards. This role is pivotal in managing legal risks, ensuring regulatory compliance, and supporting the organization’s strategic goals.

 

Scope of Authority: – 

The Legal Advisor will:

  • Report directly to the General Director and the Board when necessary.
  • Provide legal counsel to all departments including the Board.
  • Represent the Diagnostic Center in legal dealings with external entities, including regulatory bodies, government agencies, and courts.
  • Oversee external legal counsel when necessary.
  • Approve contracts, policies, and compliance programs within the scope of their role.

 

Key Responsibilities: –

 

  1. Legal Counsel and Advice

Provide expert legal advice on:

  • Healthcare Law: Licensing, regulatory compliance, patient privacy, informed consent, medical malpractice, and other relevant laws.
  • Contract Law: Draft, review, and negotiate contracts with vendors, suppliers, physicians, insurance companies, and other stakeholders.
  • Employment Law: Advise on hiring, termination, employee benefits, workplace safety, and labor law compliance.
  • Corporate Law: Guide corporate governance, mergers and acquisitions, and other organizational legal matters.
  • Intellectual Property Law: Protect proprietary methodologies and technologies used in the Diagnostic Center.
  • Conflict-of-Interest Management: Identify, address, and mitigate conflicts of interest within the organization
  • Conduct in-depth legal research and prepare reports on complex legal issues.
  • Represent the organization in legal proceedings, including litigation, arbitration, and dispute resolution.

 

  1. Compliance
  • Develop, implement, and monitor compliance programs to adhere to federal, state, and local regulations.
  • Ensure compliance with:
  • Licensing and certification requirements.
  • Data privacy laws, including GDPR or local equivalents.
  • Patient safety and quality-of-care standards.
  • Train employees on compliance issues, including data privacy, anti-corruption, and reporting mechanisms.
  • Develop and implement corrective action plans for compliance breaches.

 

  1. Risk Management
  • Conduct regular legal risk assessments and develop mitigation strategies.
  • Create and implement policies to minimize legal and regulatory exposure.
  • Monitor and respond to legal and regulatory developments in the healthcare sector.
  • Oversee data breach response plans and ensure compliance with data privacy laws.
  • Maintain adequate insurance coverage to manage potential liabilities.

 

  1. Other Responsibilities
  • Assist in the development and implementation of organizational HR policies and procedures.
  • Provide regular updates on legal and compliance matters to the General Director and leadership team.
  • Stay abreast of legal and regulatory developments in the healthcare industry and recommend necessary adjustments to policies or practices.
  • Perform other duties as assigned by the General Director and the Board.

About You

Qualifications and Experience

 

Education: –

  • LLM degree with at least 10 years of experience in legal practice, preferably in healthcare or corporate law.
  • OR LLB degree with at least 15 years of experience in a similar role.
  • Must have a registered professional license and must be VAT registered.
  • Proven experience in handling regulatory compliance, litigation, and contract negotiation.
  • Ample experience in assisting Board members on legal, contractual and other matters.
  • Strong leadership, analytical, and problem-solving skills.
  • Excellent communication skills, with proficiency in English language.

 

Salary and Benefits: –

  • Financial Benefit: Monthly Retainer fee Based on the Financial Proposal submitted by the candidates and could be negotiable.

 

Performance Evaluation 

The Legal Advisor’s performance will be evaluated annually based on:

  • Compliance with legal and regulatory obligations.
  • Effective risk management and forecasting strategies.
  • Timely and accurate legal counsel.
  • Contribution to organizational goals and objectives.
